In exercise of the powers conferred upon it under subsection (2) and sub-clauses (ii), (iii) and (iv) of clause (b) of sub-section (1) of section 11 of the Telecom Regulatory Authority of India Act, 1997 (24 of 1997) read with the Notification No.39 (S.O. No. 44 (E) and 45 (E) dated 09/01/2004) issued from file No. 13-1/2004-Restg by the Central Government under clause (d) of sub-section (1) of section 11 and proviso to clause (k) of sub section (1) of section 2 of the Telecom Regulatory Authority of India Act, 1997 (24 of 1997), the Telecom Regulatory Authority of India, makes The Telecommunication (Broadcasting and Cable) Services (Second) Tariff (Sixth Amendment) Order 2006, (5 of 2006)”. The Order shall apply throughout the territory of India. This Order shall come into force on the date of its publication in the Official Gazette.

The All India GSM subscriber base grew from 78.5 million in June 2006 to 82.4 million in July 2006 recording an addition of 3.93 million during July 2006. The Telecom Regulatory Authority of India had carried out a comparative study in 2005 on the status of telecom service sector of India and China. The comparison of performance indicators between two fastest growing telecom markets help to draw strategies for new investment and expansion of telecom networks, tariff and pricing of retail and wholesale services, usage pattern and related capacity requirement etc. The paper earlier published by the Authority was extensively used by policy makers, academicians, investors and service providers etc. The paper had also drawn interest of the media and was also reproduced in reputed journals. The Authority in continuation of its endeavor to provide such benchmark studies is publishing this revised and more extensive comparative study of performance indicators of Indian and Chinese Telecom service sectors.

The above document is a consultation paper on licensing issues relating to DTH by Telecom Regulatory Authority of India (TRAI) dated June 5, 2006. The document includes the preface, introduction, change in license conditions regarding interoperability and applicability of uplinking guidelines, use of multiple dwelling unit technology, issues for consultation and the annexures containing different letters.

The GSM mobile subscriber base crossed the 75 million mark in May 2006. The subscriber base grew from about 72 million as on April 2006 to about 75 million as on May 2006 - recorded a growth of about 4.3% during May 2006. The TRAI had sent its Recommendations to the Government in October, 2004 on Issues Relating to Broadcasting and Distribution of TV Channels. Meanwhile, TRAI had also issued Regulations covering certain issues relating to Interconnection. The primary objectives of these regulations were:

• To provide a framework for access to content by various distributors so as to enhance competition and consumer choice.

• To minimise disconnection and inconvenience to consumers on account of disputes between service providers.

• Registration of details of interconnection agreements in accordance with the provisions of the TRAI Act.

More than a year has elapsed since these regulations were issued. It is felt that it is time to take a comprehensive review of the regulations in the light of the experience gathered so far. Further certain new issues have arisen which were not addressed in the earlier regulations. Accordingly a Consultation Note had been issued on 21st March, 2006inviting stake-holders to give inputs on the issues that could be raised in the Consultation Paper.

Drawing upon the response to the Consultation Note this Consultation Paper has been prepared. The above Consultation Paper by TRAI deals with the issue of commercial tariff for broadcasting and cable television services. The Tariff Order dated 1.10.2004 did not distinguish between commercial and other services. While dealing with a batch petitions filed by the Hotel and Restaurant industry, the TDSAT in its judgment dated January 17, 2006 concluded that the Tariff Order does not cover commercial services. Accordingly, TRAI decided as an interim measure to amend the Tariff Order and provide for a ceiling for commercial tariff also. This ceiling was fixed as the tariff as on March 1, 2006. This Tariff Order was issued on March 7, 2006. As indicated in the explanatory memorandum to the Tariff Order the issue of the need or otherwise to fix tariff for commercial purpose and the method and manner of fixing specific commercial tariff are connected issues and needs a detailed consultation and examination. This paper brings out the relevant background as well as the specific issues for consultation. Section-1 brings out the background and the need for this consultation.
