Addressing Fiscal and Legal Challenges
As the Indian Economy makes rapid strides,
the Equipment Procurement and Construction activities present exciting
opportunities along with fiscal, taxation and legal challenges.
Besides the existing framework of various regulation, new changes are constantly
introduced by the Government making it imperative for both sides of the contracting
parties to keep themselves abreast of how these changes affect their businesses
and shape up potential opportunities.
With an aim to facilitate the EPC
contractors and also the Project Owners in their endeavor to update and gain a
deeper and concise knowledge of the current and evolving tax and legal issues
surrounding it, Infraline in collaboration with leading tax consulting firm BMR
& Associates has been organising two days annual workshops. The past workshops
have been very well attended by various participants across the industries
including Power, Oil & Gas, Engineering, Real Estate, Special Economic Zones,
etc. Based on their very encouraging feedback, not only the agenda has been
substantially enhanced but also one full day has been provided for the
participants to have a better understanding of the basics. The optional basic
course module is aimed towards refreshing various subjects for the industry
veterans, making them aware of the changes introduced and also preparing the
younger participants for the advanced programme.
The presentations to be made by the
speakers would aim at analyzing the finer details on tax savings, tax risks and
mitigants, contracting issues, legal imperatives during bid submissions as well
as practical aspects during tax assessments. The workshop intends to update and
enrich the knowledge base of Financial, Legal and Commercial teams of the Project
Owners as also the Contractors. The workshop will also capture all
important announcements of Union Budget 2008.
The high-point of the event is the simulation of a real-life EPC contracting bid planning and presentation, involving interactive role played by (bidding teams comprising the participants)
on Day 3 of the programme (April 19, 2008). The objective of the interactive case study is to enable application of the understanding and knowledge gained at the workshop
in preparation and delivery of an effective bid in a simulated environment. The group dynamics involved in the bid preparation and the subsequent presentation of the bid by the selected bidding team would help participants gain a practical insight on construction and evaluation of a successful EPC bid.
To
maintain the programme quality, number of participants is capped at 150.
Therefore, early

Sujit Ghosh |
Sujit Ghosh is an Executive
Director in the Firm's Indirect Tax practice, with a
specialisation in VAT and Service Tax. He joined the Firm in
October, 2004. Prior to joining BMR & Associates, he was a
senior member of Ernst & Young's Indirect Tax team.
He worked with Arthur Andersen for over seven years until the
Andersen practice combined with that of Ernst & Young in June
2002.
He has substantial experience in advising companies, domestic
and multinational, in the areas of VAT and Service Tax. His
experience spans advice on structuring and optimising national
supply chains, indirect tax issues arising from green field
operations including business model planning, procurement,
distribution, marketing and after-market related matters and
pricing and structuring complex engineering and procurement
contracting arrangements. He is also extensively involved in
providing strategic advice to service providers on an array of
issues concerning Service Tax, Service Tax credits, rebates and
other related issues, including litigation management.
He has a Bachelor's degree in Law from National Law School,

Gokul Chaudhri, FCA |
Gokul Chaudhri is
Partner with BMR & Associates. His responsibilities include
leading the Firm’s Energy & Infrastructure industry program and
leadership of select key accounts for tax advisory services.
Prior
to joining BMR & Associates in November ‘04, Mr
Chaudhri has worked with Ernst & Young and Andersen
since 1991. Mr. Chaudhri was also the leader of the
Energy, Chemicals and Mining industry for Ernst &
Young.
His
professional service experience includes significant
engagements for domestic and international energy
clients and vertically integrated energy giants. He
is an acknowledged expert in the area of upstream,
mid-stream and oilfield services taxation, in
general and taxation of farm-out transactions,
engineering, procurement and construction
arrangements, LNG contracting structuring, in
specific. In addition, he has extensive experience
in structuring and presenting in-bound foreign
investment proposals to the Government of India.
Mr
Chaudhri has been an active speaker at domestic and
international energy seminars. He is a member of the
Institute of Petroleum (now The Energy Institute,
London) and Federation of Indian Mineral Industries.
Mr Chaudhri has also been involved in fiscal reform
initiatives by the Government of India, specifically
for the energy and mining industry and was a member
of the task force on tax reforms for the mining
industry.
Mr Chaudhri holds a Bachelor of Commerce degree from
the University of Bombay and qualified as a
Chartered Accountant in 1994.

Akshay Jaitly, Partner,
Trilegal
Akshay Jaitly is a founding
Partner of Trilegal and also has long term experience of working in an
international law firm. Energy and infrastructure are one of the main areas of
his practice. He advises oil and gas clients engaged in up-stream, mid-stream
and down-stream activities and also advises on EPC contracts in a variety of
sectors including power, water, transport, pipelines.
